    If a veterinary hospital does NOT require all employees to be vaccinated, and if someone on their staff or a client contracts COVID, are they then liable for damages?  For not abiding by common sense OSHA requirements?

    An employer could potentially be liable under this type of scenario (i.e., workers' compensation liability for employees and common law negligence liability for clients).  While an employer might view certain CDC, OSHA and NYS DOH standards as unnecessary, the best practice to mitigate against potential liability, is to follow as many of the CDC, OSHA and NYS DOH standards as possible, especially those that are common sense requirements.
