If I mandate that employees must be vaccinated and if a hesitant employee gets a reaction what are my liabilities? If they have a vaccine reaction that requires medical attention, is this a workers compensation case?
Generally speaking, if an employer mandates that an employee receive a vaccine in order to be on work premises and the employee has a serious reaction to the vaccine, the employee could be entitled to workers' compensation benefits. Workers' compensation bars all other claims. So, employees would likely be blocked from seeking monetary damages in court for an adverse reaction to an employer-mandated vaccine.
